Privacy policy

1. Information we collect

When you submit a deal, we collect the information you provide directly: your full name, email address, phone number, your role in the deal, deal type, a description of what is being exchanged, the amount, and your counterparty's email address.

If a dispute is opened, we additionally collect any statement or supporting file you submit as evidence.

2. How we use this information

  • To match your submission with a counterparty's submission and create a linked deal.
  • To calculate the applicable escrow fee.
  • To allow you to look up your deal's status using your reference number and email.
  • To allow a FairBank Escrow reviewer to manage the deal, including confirming funds and reviewing disputes.
  • To contact you about the status of your deal.

3. How information is shared

We do not sell your information. Information is shared only as needed to complete a transaction, including with the financial institutions or custodial services FairBank Escrow uses to hold and move funds, and as required by law or regulatory obligation.

4. Data retention

We retain submission and deal information for as long as needed to complete a transaction and to satisfy our recordkeeping and regulatory obligations as a money services business. We keep it only for as long as those purposes require, and no longer.

5. Security

We take reasonable measures to protect the information you submit, including storing sensitive data in our database with appropriate access controls. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

6. Your rights

You may request access to, correction of, or deletion of information you have submitted by contacting us through the Contact page, subject to our need to retain certain records for legal and regulatory purposes.

7. Children's privacy

This service is not directed at anyone under eighteen years of age, and we do not knowingly collect information from minors.

8. Changes to this policy

We may update this policy from time to time. Updates will be posted on this page with a new effective date.
