Terms of service

1. Acceptance of these terms

By submitting a deal, checking a deal's status, or otherwise using this website, you agree to these Terms of Service. If you do not agree, do not use the site.

2. What this service is

FairBank Escrow provides a submission and matching intake for two types of transactions: crypto for crypto exchanges, and bank transfer for crypto exchanges. Parties submit their side of a deal without creating an account. When both sides of a deal are matched, FairBank Escrow staff hold and manage the transaction manually, including confirming funds, monitoring status, and releasing funds only after human reviewer approval.

FairBank Escrow is not a bank. Funds held during a transaction are not deposits, are not FDIC or NCUA insured, and are not guaranteed by FairBank Escrow beyond the terms of the specific escrow arrangement each party agrees to.

3. Eligibility

You must be at least eighteen years old and legally able to enter into binding agreements to use this service. You represent that all information you submit, including your name, contact details, and deal terms, is accurate and that you are authorized to enter into the transaction you are submitting.

4. Submissions and matching

Each party submits their own understanding of a deal's terms. FairBank Escrow attempts to match submissions from both named parties. A deal is not created, and no obligation exists, until both sides are matched into a single linked deal by FairBank Escrow.

If a submitted party's information does not match, or the counterparty never submits, the submission remains unmatched indefinitely and no transaction occurs.

5. Fees

FairBank Escrow charges an escrow fee calculated from the published fee schedule available on the Pricing page, based on the value of the transaction. The applicable fee is calculated and disclosed once a deal is matched. Fees are subject to change for future submissions, but the fee disclosed at the time a deal is matched applies to that deal.

6. Manual review and release

Every release of funds held in escrow requires review and approval by a FairBank Escrow staff member, in addition to confirmation from both parties. FairBank Escrow does not guarantee a specific timeline for review or release.

7. Disputes

If a disagreement arises between the parties to a deal, either party may open a dispute through the status lookup page. A FairBank Escrow reviewer will examine the submitted evidence from both sides and issue a decision to release or refund the held funds. This decision is made at FairBank Escrow's discretion based on the evidence available and the terms both parties agreed to at submission.

8. Prohibited use

  • Submitting false, misleading, or impersonated information.
  • Using the service for any transaction connected to illegal activity, including but not limited to fraud, money laundering, or the purchase of prohibited goods or services.
  • Attempting to interfere with, reverse engineer, or disrupt the operation of the site.

9. Disclaimers and limitation of liability

This service is provided on an as is basis. FairBank Escrow does not guarantee that a counterparty will submit matching information, that a transaction will complete, or that any particular outcome will result from a dispute. To the maximum extent permitted by law, FairBank Escrow's liability arising from use of this service is limited to the escrow fee paid on the transaction giving rise to the claim.

10. Governing law and dispute resolution

These terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any dispute between you and FairBank Escrow arising out of these terms, or out of your use of the service, will be brought exclusively in the state or federal courts located in New York City, and you consent to the jurisdiction of those courts.

11. Changes to these terms

FairBank Escrow may update these terms from time to time. Updated terms will be posted on this page with a new effective date. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
